Terms of use
This English text is a courtesy translation. If there is any difference between versions, the Portuguese version is the official one.
By using NomiPlay, you agree to these terms, which follow Brazil's Consumer Protection Code (Law 8.078/1990), Decree 7.962/2013 (e-commerce), the Internet Civil Framework and the LGPD. If you are a minor, use NomiPlay with the guidance of a parent or guardian.
1. Who provides the service
NomiPlay is provided by Andrey Luiz Cardoso Garcez, CPF 517.916.252-15, Rua Padre João Manuel, 173, São Paulo - SP, CEP 01411-001. Support: andgarmed@gmail.com.
2. The service
NomiPlay is a portal of digital games that run in the browser. Some games are free; others may have paid full versions. Personalization with names uses game templates that have already been developed; we do not promise to automatically create any game imaginable. Each game states its recommended age range, which is a recommendation from NomiPlay.
3. Use by children
- Children's games should be used with the guidance of parents or guardians;
- Purchases, settings and extra play time are for adults. We recommend setting a PIN in the Parents area;
- Do not use full names, offensive nicknames or third-party data without permission in personalized games.
4. Purchases and payment
- The total price, in Brazilian reais, appears before confirmation. Launch prices may change, without affecting purchases already confirmed;
- Payment is made by Pix (QR code or copy and paste, with the exact amount and the order code) or, when available, through Mercado Pago;
- With direct Pix, the purchase is released after receipt is confirmed, usually on the same business day. With Mercado Pago, release is automatic after approval;
- At this stage, the purchase unlocks the content in the browser and on the device where it was made (there is no cloud account). Keep the link to the order return page;
- If payment is made and the content is not released within 2 business days, write to andgarmed@gmail.com with the order code.
5. Right of withdrawal and refunds
You can cancel a purchase within 7 days of payment (Art. 49 of Brazil's Consumer Protection Code), without giving a reason, by writing to andgarmed@gmail.com with the order code. The amount is refunded in full by the same payment method (with Pix, to the originating account), and access to the purchased content ends. Technical problems that prevent use also give the right to a refund.
6. Educational content
The games are educational entertainment and do not replace formal education.
7. Intellectual property and non-affiliation notices
- NomiPlay's games, characters, texts, illustrations and code are protected by Brazil's Copyright Law (Law 9.610/1998). Copying, reselling or redistributing the games or their files is not allowed;
- Third-party 3D models are used under their respective licenses (Quaternius, CC0; Mixamo/Adobe characters, use permitted in games);
- Names entered by users are the responsibility of the person who entered them.
8. Proper use
You may not try to break into, overload or circumvent the site or payments, or use the service for illegal purposes. We may suspend access for anyone who breaches these terms.
9. Availability and liability
We work to keep the games running on modern browsers, but the service may undergo maintenance, changes or interruptions. Pronunciation uses the device's own voice and may vary. Nothing in these terms limits rights guaranteed by Brazil's Consumer Protection Code.
10. United States and India
The games are for children only with the permission of a parent or guardian, and only adults can buy. There are no real-money games, bets or cash prizes, and in-game coins have no monetary value. Nothing in these terms removes mandatory consumer or child-protection rights you have under the laws of your country. Our children's privacy rules for both countries are in the Privacy policy.
11. Changes, governing law and jurisdiction
These terms may be updated; the current version is on this page, with the update date. Brazilian law applies. The courts of the consumer's place of residence have jurisdiction.
